'One Nation One Election' bills unlikely to be passed in Parliament: Digvijaya Singh
AGAR MALWA: Congress Rajya Sabha member Digvijaya Singh has said he is doubtful that the 'one nation, one election' bills will be passed in Parliament. Talking to reporters in Madhya Pradesh's Agar Malwa district on Saturday night, Singh also denied the allegations against Leader of Opposition in the Lok Sabha Rahul Gandhi of pushing and shoving BJP MPs on Parliament premises on Thursday. The two 'one nation, one election' (ONOE) bills, including one requiring an amendment in the Constitution, lay down the mechanism to hold simultaneous elections and were introduced in the Lok Sabha on Tuesday after a fiery debate. The Lok Sabha on Friday referred the two bills on simultaneous polls to a joint committee of Parliament (JPC). To a question on the ONOE bills, Digvijaya Singh said, The JPC has been constituted and I don't think that it will be passed. On Thursday, an FIR was registered against Rahul Gandhi at Parliament Street police station following the BJP's complaint, accusing him of physical assault and incitement after MPs Pratap Chandra Sarangi and Mukesh Rajput were injured. The Congress has strongly rejected the claim, alleging that BJP MPs pushed Congress chief Mallikarjun Kharge and physically manhandled Gandhi. Asked about the accusations against Gandhi of pushing and shoving the BJP MPs, Singh termed them as completely false. This is absolutely wrong. There was pushing and shoving between BJP leaders, the former state chief minister claimed. One BJP MP fell on another. Both were injured. The one who fell said that Rahul Gandhi was standing in front of him. If he was standing in front, could he have pushed him? he asked. What happened in Parliament? Who is MP Pratap Sarangi injured after Rahul Gandhi's alleged push? Notably, Rashtriya Swayamsevak Sangh chief Mohan Bhagwat recently expressed concern over the resurgence of several temple-mosque disputes and said certain individuals, after the construction of Ayodhya Ram temple, seem to believe they can become leaders of Hindus by raking up such issues. To a question on Bhagwat's statement, Digvijaya Singh said, If we talk about such persons who wanted to become leaders by talking about Hindu-Muslim issues then the biggest proof in front of them is Prime Minister Narendra Modi. Why he doesn't make him (Modi) understand? Bhagwat is only delivering statements but why he keeps silent when excesses are committed against Muslims, the Congress leader claimed. To another question, Singh said such statements of Bhagwat are positive, but he should stop the organisations associated with Sangh. Vishwa Hindu Parishad and Bajrang Dal are their organisations (associated with Sangh). Why doesn't he stop them? the Congress leader asked.

Yogi Adityanath Slams Temple Desecration After Bhagwats Remarks
New Delhi: A day after RSS chief Mohan Bhagwat talked about inclusivity and gave a call to avoid raking up temple-mosque disputes, Uttar Pradesh Chief Minister Yogi Adityanath on Friday highlighted the destruction of Hindu temples in various parts of the country in the past. The Uttar Pradesh CM reiterated that protection of Sanatan Dharma is essential for world peace. Citing Kashi Vishwanath temple, Ayodhyas Ram Mandir, Mathuras Krishna Janambhoomi, and Sambhals Harihar Bhoomi temples, the Uttar Pradesh CM asserted that bhautik vikas (development) cannot be sustained by neglecting the heritage. Continuing his tirade against the emple destroyers, Adityanath, whose atenge to katenge slogan was seen as a gamechanger by many in the BJP during the Maharashtra Assembly polls, also asserted that the descendants of those who desecrated these temples will be destroyed. The CM reiterated that Sanatan Dharma is the only way to establish world peace. The Uttar Pradesh CM was speaking at a religious event in Ayodhya, where he also mentioned atrocities on Hindus in Bangladesh, Pakistan and Afghanistan and asked, I want to ask who were those people who destroyed the Sanatan Dharmas places of pride in the country and why did they do it? It was a part of the conspiracy to make the whole Earth a hell by carrying out these barbaric acts Whether it was Ayodhya's Ram Janmabhoomi, Mathura's Krishna Janmabhoomi or Sambhals Hariharbhoomi...these places were destroyed, desecrated or made impure The lineage and descendants of those who desecrated these temples will be destroyed, said Adityanath. Talking about ongoing atrocities on Hindus in Bangladesh, the Uttar Pradesh chief minister said, Do not forget that it is only the Sanatan dharma that has given refuge, protection and an opportunity to live and prosper to all castes, religions and sects in times of adversity But are Hindus being treated the same in other parts of the world? What is happening in Bangladesh today or what happened in Pakistan or Afghanistan? I want to ask who destroyed the symbols of Sanatan dharma and why? Adityanath asked Indians to be prepared so that the country does not have to face gulami ki bediyan again and see its religious places getting desecrated. Adityanath's remarks came a day after the RSS chief, at an event in Pune, had said that one does not become a Hindu leader by building a Ram temple and spoke about developing a model of harmony in the country that could be adopted by the world. The Ram temple is a matter of faith for HindusHindus believed the Ram temple should be constructed. But by doing that, one does not become a Hindu leader We talk of becoming Vishwaguru (global leader) and not Mahashakti (superpower). This is because we have seen how people behave after becoming superpowers. To achieve selfish gains for the sake of supremacy is not our path, Bhagwat had said on Thursday. The RSS chief said, ... We have to show the world that we can do it togethermany sects and ideologies that accommodate everyone

RSS chief Mohan Bhagwat bats for inclusive society, frowns upon new disputes
PUNE: RSS chief Mohan Bhagwat has expressed concern over resurgence of several temple-mosque disputes and said certain individuals, after the construction of Ayodhya Ram temple, seem to believe they can become leaders of Hindus by raking up such issues. Delivering a lecture on India The Vishwaguru', at Sahjeevan Vyakhyanmala (lecture series) here on Thursday, Bhagwat advocated for an inclusive society and said the world needs to be shown that the country can live together in harmony. Highlighting the plurality of Indian society, the chief of Rashtriya Swayamsevak Sangh (RSS) said Christmas is celebrated in Ramakrishna Mission, adding only we can do this because we are Hindus. We have been living in harmony for a long time. If we want to provide this harmony to the world, we need to create a model of it. After the construction of the Ram Mandir, some people think they can become leaders of Hindus by raking up similar issues in new places. This is not acceptable, he said. The Ram temple was constructed since it was a matter of faith for all Hindus, Bhagwat said. Every day a new matter (dispute) is being raked up. How can this be allowed? This cannot continue. India needs to show that we can live together, he said without mentioning any particular site. Several demands for surveys of mosques to unearth temples have found their way to courts in the recent past, though Bhagwat did not mention any by name in his lecture. Some groups that came from outside brought with them staunchness and they want their old rule to return, he said. But now the country runs as per the Constitution. In this setup, people choose their representatives, who run the government. The days of hegemony are gone, he asserted. He said the rule of Mughal emperor Aurangzeb was characterised by such staunchness, though his descendant Bahadur Shah Zafar in 1857 banned cow slaughter. It was decided that Ram Mandir in Ayodhya should be given to Hindus but the British sensed it and created a rift between the two communities. Since then, this sense of algavwad' (separatism) came into being. As a result, Pakistan came into existence, he said. Bhagwat asked why the language of dominance was being used if everybody identifies themselves as Indians. Who is a minority and who is a majority? Everyone is equal here. The tradition of this nation is all can follow their own forms of worship. The only requirement is to live in harmony and abide by rules and laws, the RSS chief asserted.

No endeavour to build Ayodhya mosque, reclaim land given for it: BJP leader to Adityanath
The Sunni Central Waqf Board formed the Indo-Islamic Cultural Foundation to build a new mosque on the land allotted by the State government in the Dhannipur area of the district
BJP leader Rajneesh Singh urged Uttar Pradesh CM Yogi Adityanath to reclaim land allocated for a mosque in Ayodhya, alleging the Muslim community's intent was not to build a mosque but to create discord. Singh claimed the land was being used for other purposes and that a mosque was unnecessary for prayer.
No endeavour to build Ayodhya mosque, reclaim land given for it: BJP leader to CM Adityanath
AYODHYA: A BJP leader here has written to Uttar Pradesh Chief Minister Yogi Adityanath, asking him to reclaim the land allotted for the construction of a mosque here and claiming that no substantial endeavour has been undertaken to build it. On November 9, 2019, settling a fractious issue that went back more than a century, a five-judge bench headed by the then CJI Ranjan Gogoi paved the way for the construction of the Ram temple in Ayodhya, at the site where the 16th century Babri Masjid once stood. It also ruled that an alternative five-acre plot would be found for a mosque in the holy town. The Sunni Central Waqf Board later formed the Indo-Islamic Cultural Foundation to build a new mosque on the land allotted by the state government in the Dhannipur area of the district. BJP leader Rajneesh Singh, in his letter to the chief minister on December 10, said that since the apex court's verdict, o substantial endeavour has been undertaken by the Muslim community to construct the mosque. Their intention was never to establish a mosque there but to perpetuate the discord under the pretext of a mosque, he alleged. In compliance with the Supreme Court's order, the land allocated to Sunni Central Waqf Board in Ayodhya is being used by the mosque's responsible persons for other purposes. The Muslim community's intention was never to construct the mosque but rather to keep the disturbance and disorder alive under the guise of a mosque. However, this has not been possible due to your leadership, Singh said in the letter to Adityanath. Asserting that a mosque is not necessary for offering prayers anyway, he appealed to the chief minister to issue strict instructions to the officials of the Ayodhya mosque trust to use the land in compliance with the Supreme Court orders. In case of being unable to do so, issue directives to return the land to the government to prevent its misuse, Singh said. In a conversation with PTI , he said, The Muslim community merely wishes to preserve Babar's legacy through this mosque and aims to manipulate Hindu sentiments in the name of Babri Masjid. When PTI contacted Athar Husain, the secretary of the Ayodhya Masjid Trust, for his reaction to the issue, he refused to comment. In 2022, Singh petitioned the Allahabad High Court, claiming that the Taj Mahal mausoleum is an ancient temple dedicated to the deity Lord Shiva and is known as the Tejo Mahalaya.

MP Gurumurthy appeals for railway development in Tirupati region
Tirupati: Tirupati MP Dr Maddila Gurumurthy on Monday voiced concerns over various railway-related issues in the Tirupati parliamentary constituency during Parliaments Zero Hour. He brought several critical matters to the attention of the Central government, emphasising the urgency of addressing them. Highlighting the increasing railway traffic, Gurumurthy stressed the need for constructing a third railway line between Renigunta and Gudur. He explained that this line would reduce the burden on existing tracks and facilitate faster travel. He also urged the government to expedite the completion of the new railway line between Pudi and Yerpedu which would enhance connectivity and play a vital role in boosting local economic resources. The MP pointed out that several train stoppages were discontinued during the Covid-19 pandemic and requested their restoration, particularly at Vendodu, Naidupeta and Sullurpeta stations. He argued that reinstating these stops would improve transportation facilities for passengers in the region. Additionally, he called for MEMU train services between Tirupati-Nellore and Tirupati-Kadapa to benefit daily commuters. Raising concerns about the narrow underpass at Gudurs Ambedkar Nagar, Gurumurthy highlighted the severe traffic problems it causes. He urged its expansion to ease the situation. He also proposed introducing a Vande Bharat sleeper train service between Tirupati and Visakhapatnam to provide faster travel options for passengers. The MP appealed for the launch of a new train service connecting Tirupati with Varanasi and Ayodhya which would serve pilgrims and travellers efficiently. By presenting these issues, Gurumurthy urged the railway minister to prioritise these projects and expedite their implementation to address the regions pressing needs.

Speaking at the World Hindu Economic Forum 2024 on Saturday, he also accused the Congress of practising double standards. Whoever speaks the truth, these people will pressurise him with impeachment (motions), and still they talk about the Constitution.Look at their double standards, he said. An Allahabad High Court judge said there should be a Uniform Civil Code, and the world over feelings of the majority community are respected, the UP chief minister said. The world over, the system runs as per what the majority community says, and India is saying the discrimination between majority and minority communities should end. They (the Congress) will pressurise, because it is their old habit of strangulating the Constitution and managing the system of the country, Adityanath alleged. India cannot establish itself as a strong economy by forgetting its legacy, the UP chief minister said. India's economy stood at 10th or 11th position after 70 years, but Prime Minister Narendra Modi made it the fifth largest economy in 10 years, and in 2027, India will be the third largest economy, the BJP leader said. Shree Jagannath temple to implement AI to manage pilgrims, enhance security
BHUBANESWAR: Shree Jagannath temple in Puri will soon join the league of popular ancient shrines of India that are leveraging artificial intelligence (AI) to manage crowds and enhance security of devotees. The 12th century shrine spread over an area of 10.7 acre gets a daily footfall of 30,000 to 50,000. But, during days of religious significance or special occasions like New Year, this number goes up to two to five lakh. With the temple administration and police facing the difficult task of managing teeming crowds ever since the four gates were reopened six months back, the former has decided to install a comprehensive AI-driven footfall counting and security detection system across critical zones within the shrine. The temple administration on Thursday asked six companies shortlisted for the project to conduct proof of check of the entire system to check its functionality and accuracy in the shrine. Under this project, officials said AI-based high-resolution camera and sensors will be installed at 41 points of the entire shrine premises to count devotees accurately. The system will include data visualisation on a centralised dashboard and a mobile application for easy access to the real-time footfall data. Temples like Ram Mandir in Ayodhya, Meenakshi temple in Madurai, Mahakaleswar in Ujjain and Venkateswara Swami temple in Tirupati are using AI solutions.

The top court is seized of the pleas, including one filed by Ashwini Upadhyay who has prayed that sections 2, 3 and 4 of the Places of Worship (Special Provisions) Act, 1991, be set aside. Among the various reasons submitted was the contention that these provisions take away the right of judicial remedy to reclaim a place of worship of any person or a religious group. The Communist Party of India (Marxist) and Maharashtra MLA Jitendra Satish Awhad have also filed pleas against several pending petitions challenging the constitutional validity of the Places of Worship (Special Provisions) Act, 1991, saying the law protected public order, fraternity, unity and secularism of the nation. The matter will be heard in the backdrop of several suits filed in various courts, including those related to the Gyanvapi Mosque in Varanasi, Shahi Idgah Mosque in Mathura and Shahi Jama Masjid in Sambhal, claiming these were built after destroying ancient temples and seeking permission to allow the Hindus to offer prayers there. The Muslim side, in most of these cases, has cited the 1991 law to argue that such suits are not maintainable. As many as six petitions, including those filed by former Rajya Sabha MP Subramanian Swamy, have been filed against the provisions of the 1991 law. Swamy wanted the apex court to ead down certain provisions to enable Hindus to stake claim over the Gyanvapi Mosque in Varanasi and Shahi Idgah Mosque in Mathura, while Ashwini Upadhyay claimed the entire statute was unconstitutional and no question of reading down arises. The doctrine of reading down a law is generally used to save a statute from being struck down entirely subject to adjudication over its constitutionality. On the other hand, Jamiat Ulama-i-Hind had cited the five-judge Constitution bench judgement in the Ram Janmabhoomi-Babri Masjid title case, noting the reference to the Places of Worship (Special Provisions) Act, 1991, to argue that the law cannot be set aside now. The top court had on March 12, 2022, sought the Centre's response to the plea filed by Upadhyay challenging the validity of certain provisions of the law. The petition alleged the 1991 law creates an arbitrary and irrational retrospective cut-off date of August 15, 1947, for maintaining the character of the places of worship or pilgrimage against encroachment done by fundamentalist-barbaric invaders and law-breakers. The 1991 law prohibits converasion of any place of worship and provides for the maintenance of the religious character of any place of worship as it existed on August 15, 1947, and for matters connected therewith or incidental thereto. The law had made only one exception -- on the dispute pertaining to the Ram Janmabhoomi-Babri masjid in Ayodhya.

Bombay HC grants bail to 14 accused in Mira Road communal violence case
MUMBAI: The Bombay High Court has granted bail to 14 Muslim men arrested for their alleged involvement in the communal violence in Mira Road on the eve of the consecration of the Ram Temple in Ayodhya, noting that their further detention appeared enuous. A single bench of Justice N J Jamadar on Monday noted that prima facie, it cannot be inferred that there was a premeditated conspiracy to assault people part of the convoy taken out to celebrate the temple consecration ceremony in January this year. The bench also highlighted that no CCTV footage showed the accused persons assaulting the complainant or anyone else. The court said the probe in the case was complete, and since the accused have roots in the society, the possibility of fleeing from justice was remote. The bench also took note of the fact that the accused have been in custody since January, and it appears extremely unlikely that the trial will be concluded soon. Hence, further detention would be unwarranted. The accused, booked under various provisions of the Indian Penal Code and Arms Act, moved the high court after a sessions court in neighbouring Thane district denied them bail. According to police, the accused were part of a mob of 50 to 60 persons that surrounded the complainant and others who were part of the convoy started raising slogans and assaulted them. The high court, in its order, said there has to be prima facie material to show that the accused were members of the unlawful assembly. The bench also noted that the convoy's entry into the locality where the alleged incident took place was a matter of chance, and hence, it cannot be inferred that there was premeditation or a prior meeting of mind to attack the members of the rally. In the case at hand, the alleged rioting was committed by more than 50 to 60 persons. Where the guilt of the accused would hinge upon their identity as members of the unlawful assembly, who shared the common object to commit the alleged offences, their further detention as undertrial prisoners appears tenuous, the court said.
Ram temple effect: Land in Ayodhya at premium price tag
The same left-liberal cabal crying foul over Justice Yadavs remarks lauded former Supreme Court judge Rohinton Nariman for his sharp critique of the 2019 Ayodhya verdict, delivered just days before the VHP event.
NEW DELHI: The Polit Bureau of the Communist Party of India-Marxist (CPM) on Monday expressed serious concern over the spate of lawsuits being filed and entertained in lower courts claiming that there were temples where centuries-old mosques stand at present. It is unfortunate that the Supreme Court has not intervened to put a stop to such litigation by upholding the Places of Worship (Special Provisions) Act, l991. The 2019 five-member Bench judgment of the Supreme Court on the Ayodhya dispute categorically upheld the validity of the law and its enforcement. Given this direction, it is incumbent on the apex court to intervene to put a stop to legal proceedings, which are violative of the Act, read the statement issued by the Polit Bureau. The statement further said that after Varanasi and Mathura, in Sambhal, a survey was ordered of a 16th-century mosque by a lower court and it had resulted in violence in which four Muslim youth have been killed. The party also mentioned a similar petition that was filed in the civil court in Ajmer regarding the Ajmer Sharif Dargah. On situation in neighbouring Bangladesh, the party reiterated that the Bangladesh interim government and authorities must ensure the safety and full protection of religious minorities. The administration seems to be ignoring the activities of the Islamist fundamentalist forces in this regard, the CPM said. At the same time, the Polit Bureau decried the efforts of the BJP-RSS and Hindutva outfits in India, which are seeking to whip up passions by incendiary propaganda. Such an approach will not help the interests of the minorities in Bangladesh, said the party. The Polit Bureau further called upon secular and democratic forces in both countries to come out strongly against all forms of communalism which will harm the interests of the people on both sides of the border. It alsk sharply criticized Government's callous indifference in denying Kerala the rightful assistance for the victims of the devastating landslide disaster in Wayanad. Despite the state's urgent plea for Rs 214.68 crore in immediate relief and Rs 2,319.1 crore for comprehensive recovery and reconstruction, the Centre has failed to approve the funds even after four months. The refusal to classify the landslide as a calamity of severe nature and the unwillingness to waive loans for the affected families also reflect a deeply unjust and inhumane approach, undermining the principles of federal support in times of crisis, the CPM stated The Polit Bureau also called upon the Centre to immediately release the funds claimed by the state government. Through the statement, the CPM also condemned the police 'repression on the farmers' of Greater Noida in Uttar Pradesh. Around 150 leaders and activists of the All India Kisan Sabha (AIKS) and other organisations have been jailed, the party said. The arrested farmers have started a hunger strike in jail. House arrests of many activists are going on. The attack on women who have been in the forefront of the struggle by the police is shocking...The CPI(M) fully supports this struggle, demands that repression must be stopped forthwith and the government must accept and implement the just demands of the struggle, said the party. The statement was issued after the pilot bureau meeting held in New Delhi. In the meeting, the Polit Bureau discussed a Draft of the Political Resolution to be taken up at the 24th Congress to be held in the first week of April 2025. Based on the discussion in Polit Bureau, the Draft will be placed for adoption in the next meeting of the Central Committee to be held in January in Kolkata.

Ayodhya verdict likely to be in frontlines of the battle for Places of Worship Act in SC
Observations made in the judgment impress, in less than 10 pages, the necessity to keep alive a Central law so intrinsically related to the obligations of a secular state
BHUBANESWAR: At the tender age of 16, Santoshi Deos life took a terrible turn when she was married off to a Brahmin family in Haryana. What followed was a harrowing tale of dowry torture and domestic violence that nearly crushed her spirit. But she refused to bow down to the circumstances and chose to fight back. Two decades later, this school drop-outs journey from mineral-rich Keonjhar district is a remarkable story of resilience, grit, and determination. Santoshi left her in-laws house, worked in a spinning mill in Tamil Nadu, drove an auto-rickshaw, bus and did whatever she could to eke out a living. This gritty woman, sixth among nine children of her parents, is an inspiration for many as she drives a 40-tonne Volvo truck, once a men-only job, through the uneven patches of an iron ore mine in Koida in Sundargarh district. After her return to her parental home at Badamuni village under Handibhanga panchayat in Sadar block, she, however, faced humiliation instead of family support. Undeterred, she resolved to forge her own path and migrated to Tamil Nadu in search of livelihood to work at a spinning mill. A couple of months after I left my in-laws house, I got the opportunity to work in the spinning mill. There, I gave birth to my daughter in 2012. For the next three years, I toiled hard, saving every penny to raise my daughter and build a better future, she said. In Chennai, she came across a woman driving an auto-rickshaw and it sparked a dream. If she can drive, why cant I, she thought and this became the turning point in her life. In 2015, with her savings and a small loan, she bought an auto-rickshaw and returned to Keonjhar. It was not long before she moved to Bhubaneswar in 2017 to secure a better future for her daughter. She enrolled her child in a government primary school in the city and began driving an auto to support their modest living, earning praises from the then chairman of Odisha Skill Development Authority Subroto Bagchi and many top bureaucrats. In 2015, with her savings and a small loan, she bought an auto-rickshaw and returned to Keonjhar. However, her ambitions did not stop there. She trained herself to drive heavy vehicles. Her hard work paid off when she was hired as a driver for Mo Bus, a city bus service run by Capital Region Urban Transport (CRUT), in 2021. For a brief moment, she became the face of women empowerment as Odishas lone woman bus driver. Surprising though, her success story led to her dismissal. I was deployed as a driver of Mo Bus for the Railway Station-Patrapada route. As I was the first woman bus driver, local media highlighted it. A month later, my authorities disengaged me. I am yet to comprehend what was my fault, she said. Yet again, life tested her resolve. She returned to auto-rickshaw driving to sustain her family. Six months ago, a mining company recognised her perseverance and courage. She was offered to drive a Volvo truck, a role predominantly dominated by men. She now earns a monthly salary of Rs 22,000, proving that with determination, no dream is unattainable. Her personal life, however, remains a battle. Trapped in a marriage she wants to leave behind, she has filed for divorce from her husband, who refuses to grant it. In 2017, she even drove her auto-rickshaw all the way to New Delhi to track her husband and meet Prime Minister Narendra Modi seeking justice for herself and her daughter. I could not meet him. But I met Union Minister Jual Oram and submitted my representation, she said. Santoshi has built a house in her native village where she stays with her mother while her daughter stays in the hostel. She still drives auto during her off-days for some extra bucks. She drove it to Ayodhya to attend the inauguration ceremony of Ram Mandir in January and drew appreciation at different locations during her journey from Odisha to Uttar Pradesh.
SC forms special bench headed by CJI to hear PILs challenging 1991 Places of Worship law
NEW DELHI: The Supreme Court has constituted a special bench to hear a batch of PILs challenging the validity of certain provisions of a 1991 law that prohibits filing a lawsuit to reclaim a place of worship or seek a change in its character from what prevailed on August 15, 1947. A three-judge bench of Chief Justice Sanjiv Khanna and Justices Sanjay Kumar and K V Viswanathan is likely to hear the matter on December 12 at 3:30 pm. The top court is seized of the pleas, including one filed by Ashwini Upadhyay who has prayed that sections 2, 3 and 4 of the Places of Worship (Special Provisions) Act, 1991 be set aside. The 1991 law prohibits conversion of any place of worship and provides for the maintenance of the religious character of any place of worship as it existed on August 15, 1947, and for matters connected therewith or incidental thereto. Travesty of Justice that secularism not given its due in Ayodhya Verdict: former SC Judge Nariman
Justice Nariman criticises 2019 Ramjanmabhoomi-Babri Masjid judgment, calls for strict implementation of the Places of Worship Act to prevent disputes
Travesty of justice that secularism not given its due in Ayodhya verdict, says ex-SC judge Nariman
NEW DELHI: Former Supreme Court Justice R F Nariman has criticised the top court's 2019 judgement in the Ramjanmabhoomi-Babri Masjid case, describing it as a great travesty of justice that did not do justice to the principle of secularism. Speaking at the First Justice A M Ahmadi Memorial Lecture on 'Secularism and the Indian Constitution', Justice Nariman, however, said the judgment had a silver lining as it upheld the Places of Worship (Special Provisions) Act 1991. He said the Places of Worship Act should be strictly implemented to end disputes over religious places which are popping up every day across the country like hydra heads. In my opinion, a great travesty of justice was that secularism was not given its due by these judgements, Justice Nariman said. He also disagreed with the reasoning given by the court to grant the disputed land despite holding that the demolition of the mosque was illegal. Today we find hydra heads popping all over the country. We find suits after suits not only against mosques but also against dargahs. All this, according to me could lead to communal disharmony. The only way to scorch and cauterize all this is by applying these five pages in this very judgement and having it read out in every district court and high court. As these five pages are a declaration by the Supreme Court which binds each of them, he said. The former apex court judge also pointed out how a special CBI judge -- Surendra Yadav -- who acquitted all the accused in the mosque demolition case, got a post-retirement job as deputy Lokayukta in Uttar Pradesh. This is the state of affairs in this country, he said.

Cash found from seat allotted to Abhishek Singhvi, claims RS chair Dhankhar; Congress MP hits back
NEW DELHI: Rajya Sabha Chairman Jagdeep Dhankhar on Friday said a wad of currency notes was recovered by security staff from the seat allotted to Congress MP Abhishek Manu Singhvi. Uproar was witnessed from both treasury and opposition benches over the issue. The currency was recovered from seat no.222, which is allotted to Singhvi, on Thursday after the sitting of the House, he said. After adjournment of the House yesterday, a wad of currency notes was apparently recovered by security officials from seat no 222 presently allotted to Abhishek Manu Singhvi, elected from the state of Telangana, the Rajya Sabha Chairman said. Dhankar said as per practice, an investigation has been ordered. Sansad TV. pic.twitter.com/ALVwKONE7L The New Indian Express (@NewIndianXpress) December 6, 2024 The Chairman said the wad is of Rs.500 notes, and appears to have 100 notes. He also said it was not clear if the currency notes were real or fake. It was my duty and I'm obliged to inform the House. This is a routine anti-sabotage check which takes place, he said. Dhankhar added that he was expecting someone would claim the currency notes, but no one has claimed it so far. Does it reflect the state of the economy that people can afford to forget it, he said. In response to the RS Chairman's statement, Singhvi said that he was astonished to hear this, adding that if there is a failing in the security agencies that must also be completely exposed. I am quite astonished to even hear about it. I never heard of it. I reached the inside of the House yesterday at 12.57 pm. The House rose at 1 pm. From 1 to 1:30 pm, I sat with Ayodhya Prasad in the canteen and had lunch. At 1:30 pm, I left Parliament. So my total stay in the House yesterday was 3 minutes and my stay in the canteen was 30 minutes. I find it bizarre that even on such issues politics is raised, the Congres MP said. Of course there must be an inquiry as to how people can come and put anything anywhere in any seat. It means that each of us must have a seat where the seat itself can be locked and the key can be carried home by the MP because everybody can then do things on the seat and make allegations about this. If it was not tragic and serious it would be comical. I think everybody should cooperate in getting to the bottom of this and if there is a failing in the security agencies that must also be completely exposed, Singhvi added. The assertion triggered an uproar from the Opposition benches, with Leader of Opposition Mallikarjun Kharge saying the Chairman should not have named the member without the investigation being completed. You said that this matter is under investigation then his/her name should not have been taken. I request that until the investigation is done and the authenticity of the incident is established, a member should not be named. Can he do like this? Aaisa chillar kaam krti hai aur deshj ko of barbaad kr rahe hai yeh log (BJP), Kharge said. Why should there be objection to the name being taken? Chairman has pointed out seat number and member who occupies that, what is the problem with that, Parliamentary Affairs Minister Kiren Rijiju responded. He said carrying bundles of notes in the House is not appropriate, adding that he agrees there should be a serious investigation. Dhankhar added that the step taken by him was 'minimal'. The winter session of the Parliament commenced on November 25, with both Houses getting adjourned fairly early due to disruptions. The winter session will go on till December 20.

BJP gears up for campaigning efforts in Ayodhya's Milkipur ahead of by-poll
LUCKNOW: After sweeping seven out of nine seats in the recently held by-poll, BJP has intensified its efforts to wrest the high-stake Milkipur seat in Ayodhya where the bypoll is scheduled soon. The party has deputed two more key organisational functionaries UP minister JPS Rathore and MLC Dharmendra Singh who led the party win in Kundarki (Moradabad) and Katehari (Ambedkarnagar) assembly bypolls, respectively where the lotus bloomed after three decades. Both Rathore and Dharmendra Singh are mandated to work alongside state ministers Surya Pratap Shahi, Mayankeshwar Singh, Girish Jatav, and Satish Sharma. Rathore, a known strategist in the party, is an MLC and UP cooperative minister in Yogi cabinet. He joined the state government after the BJP returned to office in 2022. He was tasked with ramping up BJP poll preparation in the Kundarki seat which has over 50 per cent of Muslim voters. Kundarki also faced a bypoll following the election of SP MLA Zia-Ur-Rehman Barq to Lok Sabha from Sambhal. BJPs victory in Kundarki consolidated Rathores position in the party. On the other, Dharmendra Singh being entrusted with Milkipur bypoll is equally significant. Singh has been a key organisational leader in the Gorakhpur region, the turf of Yogi Adityanath. Just over a year ago, Singh was anointed partys state vice-president while being nominated for the legislative council. Singh, an OBC, was deployed in Katehari, which has a sizable population of OBC and Dalits. As per the political experts, the BJP wants to capitalise on its victory in the bypolls. Milkipur, the reserved seat had fallen vacant following the election of SP nine-time MLA Awadhesh Prasad who had emerged as the master killer by defeating BJPs sitting MP Lallu Singh in Faizabad (Ayodhya) seat in recent Lok Sabha elections. However, the EC had postponed the bypoll since an election petition concerning Milkipur in Lucknow bench of Allahabad high court. The HC dismissed the pending petition last week, thereby clearing the decks for bypoll in Milkipur. Milkipur may well turn out to be another battle of prestige between the BJP and the SP since the BSP has opted out and Congress has decided to back SP. A per the party sources, ground-level preparation have already intensified in Ayodhya while revamping its organisational structure at the booth and mandal level. The Milkipur assembly seat has 414 booths and five divisions, which are scheduled to have a new set of functionaries. Analysts said that the BJP is expected to play on its tried and tested Hindutva pitch with a focus on Yogis Batenge toh katenge call to counter SPs caste narrative of Pichhda, Dalit, and Alpsankhyak (PDA).

Shikha Mukerjee | Digs and gigs: Ajmer Sharif & archaeology of Hindutva
It is a snowball gathering speed. Or may-be its a mudslide gaining momentum. Or maybe its a virus. Whatever it is, it seems to be birthing more and more litigation across mostly North India. It certainly seems that keeping the country on the boil is back in favour as a tried, tested, easy and successful strategy for the Hindu Right, led by the BJP and the nearly 100-year-old voluntary social service outfit RSS. On a mission to hoist India to the pinnacle of glory by reorganising history, chronically litigious Hindu outfits like the International Hari Har Sena Sri Ram Sena, Hindu Sena and a bevy of lawyers and fervent petitioners have filed a slew of cases, in war mode in district courts across North India. The demand is straightforward: demolish and dig up 30,000 sites where believers are certain temples were built over and mosques established. By adding Ajmer Sharif, the shrine of Khwaja Moinuddin Chisti, that needs to be dug up to reportedly uncover a temple dedicated to Lord Shiva, the Hindu Right has outdone itself. Among the devout, it is usual to place chadars, a sheet, on the grave of the Sufi mystic. Among those who have done so in recent times are Indias Prime Minister Narendra Modi and tens of thousands of devotees from all across the world. When Mr Modi sent the chadar, duly captured on camera, it was believed he was trying to appease Muslim voters ahead of the 2024 Lok Sabha elections. Others, however, have prayed and visited Sufi shrines, including the Fatehpur Sikri dargah near Agra, like former French President Nicolas Sarkozy and his partner Carla Bruni, who prayed for a child and indeed had one. Hindutva or Hindu fundamentalism, or Hindu revival though why something that flourished for millennia needs rev-ival is a mystery, because it never faded, verged on extinction, though it was in danger of being eclipsed by Buddhism around and after Emperor Ashoka's times. But in twenty-first century In-dia, some people believe it needs kindling to keep it burning. Reviving temples suspected or believed to have been destroyed is the new and supplementary agenda of Hindutva. A new archaeology has been established in service of Hindutva. Thanks to former Chief Justice of India D.Y. Chandrachud, the starter or spark or kindling was his 2022 decision to overturn the 1991 law, which sought to prohibit conversion of any place of worship and to provide for the maintenance of the religious character of any place of worship as it existed on the 15th day of August 1947, otherwise known as the Places of Worship Act. While the law was meant to be tamper proof, the former Chief Justice, who seemed to fuse his piety with his professional responsibilities, decided that digging into the foundations of Varanasis Gyanvapi Masjid to uncover a Shiva linga was perfectly in order. The outcome of the reversal and its consequences are four dead and several injured in UPs Sambhal over a dispute on what lies below the Shahi Jama Masjid. The claim by a mahant was followed up by a lawyer, who is involved in other places of worship disputes, starting with the Gyanvapi, Mathuras Shahi Idgah Mosque and the Sambhal dispute. Having retired and thus free to presumably pursue his pieties in private, instead of in front of a camera that turned his devotions into a public spectacle, the retired Chief Justice can now watch from the sidelines the consequences of his decision. The Hindu Right in pursuit of Hindu revival, aided and abetted by a judiciary that brandishes God to support its decisions that are fundamentally flawed, as in the Ayodhya land dispute, is now part of the archaeology of Hindutva. To legitimise the digs and gigs, advocates and various litigants have a judiciary that is willing to overturn the law to enable what the law said could not be done. So, claims can be confidently made that legal proceedings will progress faster than a bullet train and that justice, as defined by them, will be done. Hindutva archaeology is essential to the project of de-Islamisation, as Mujibur Rahman calls it in his recent book, Shikwah e Hind. Digs and gigs are the window dressing required to legitimise the supplementary project to avoid committing what the apex court led by former Chief Justice Ranjan Gogoi described as a heinous crime, of mosque demolition in the Ayodhya case. The law and the taxpayer are vulnerable to being used as a tool of cynical exploitation of sentiment since the Hindu revivalists are essentially a bunch of freeloaders ra-ther than philanthropists or zealous crusaders. With the courts turning into the revivalists fa-vourite tool, the changes proposed to the law on Waqf properties will certainly add to the thousands of cases that are already in the judicial system over land and other disputes relating to Waqf-administered properties. The choice for the Narendra Modi government is simple: it can support the supplementary project of mosque demolition-temple rebuilding and do so by abandoning the Constitution and its basic structure of which secularism is a part. Or, he can rein in the Hindu Right and demolish the supplementary project. He can follow the route he has adopted on the Waqf issue or duck responsibility, albeit temporarily. If that is a choice too stark for the Prime Minister, he can resort to playing cat and mouse with the secularism project and the supplementary project of Hindutva. Legalising the demolition of Muslim places of worship on the pretext of unverified claims to temples buried under them is a political problem; it is not a problem that the judiciary can solve. The choice and decision that the Modi government has to make is simple. It can either amend the 1991 Places of Worship Act and open the floodgates to the new archaeology that Hindutva is trying to establish; or, it can, in Parliament, in this Win-ter Session, unequivocally declare its commitment to upholding the 1991 law. Any waffling on this as a government is unacceptable. Flawed and weak as the attempt may have been, from within the ranks of the BJP there was a move to throw out the words secular and socialist added through the 42nd Amendment in 1976. The Supreme Court, currently headed by Chief Justice Sanjiv Khanna, has thrown out the petition. It does not mean that another petition will not be filed at a different time to which the apex courts response could be different. The Places of Worship Act reversal is a case in point; mischief can be made whenever there is a convergence of ideas, ideologies, politics and petitioners.
