NRIs Pin Hopes on US Elections for Quicker Green Cards
Hyderabad: More than 12 lakh Indians, working in the United States, have pinned hopes on the outcome of the US Presidential elections to end their almost unending wait list to secure employment-based green cards. Over 1.5 lakh Indians are waiting to get green cards permanent residence visa under EB-1, where EB refers to the extraordinary ability of the applicant, while wait time for EB-2 and EB-3 extends to over two decades. Many Indians, who have an academic background in STEM (science, technology, engineering and medicine), are considering the EB-1A option, a subset of EB-1. The per-country cap is creating long backlogs for individuals from countries with high demand, especially India, where the wait for employment-based green cards extends decades. Vice-President Kamala Harris, as a senator, co-sponsored the Fairness for High-Skilled Immigrants Act, which sought to eliminate the per-country caps on employment-based green cards. This legislation was welcomed by many in the Indian community, as it would significantly reduce green card wait times for those affected by backlogs. However, during his term, former President Donald Trump did not advance legislation to remove the per-country cap. Many viewed his administrations stance as generally restrictive on legal immigration, though some had hoped that Trumps focus on merit-based immigration could indirectly address backlogs by reforming green card distribution. While Harris the Presidential candidate from Democrats remains supportive, any change requires broader Congressional support. Though the Joe Biden administration has shown an interest in immigration reform, progress has been slow due to competing priorities and a divided Congress. Dheeraj Kulkarni, who works for LogicMate, an AI company in New York, says that they are hopeful that if comprehensive immigration reform moves forward, it will include adjustments to the green card caps. However, he is apprehensive that the outcome remains uncertain, and many Indians continue to press lawmakers to prioritise backlog relief. As the United States votes to elect its new President, the per-country cap on green cards has been a key point of debate. Kamala Harris argued that these caps place individuals from high-demand countries, like India and China, at disadvantage. Her position generally aligns with a push for more inclusive immigration reforms that facilitate skilled workers ability to stay in the US. Trump's focus was often on limiting immigration as a whole, rather than changing the per-country cap. However, in the current election debate, Trump advocated a merit-based system that could prioritise skills over country of origin. Arun Reddy from Telangana Peoples Association of Dallas (TPAD) said that a legislation was proposed under the Biden administration, which proposed to eliminate the per-country cap, and allow for a first-come, first-served system, potentially shortening wait times for Indians in the backlog. However, this change is still under debate. The American Telugu Association (ATA) and the Telugu Association of North America (TANA), along with other Indian American Organisations, have been advocating for the removal of per-country caps on employment based green cards. These groups have supported legislative efforts like the Fairness for High-Skilled Immigrants Act and the EAGLE Act (Equal Access to Green Cards for Legal Employment) which seek to phase out per-country limits. Although these bills have seen varying degrees of support in Congress, they have not yet become law. Visakhapatnam : The Bheemli police in Visakhapatnam have arrested Korupolu Jay Jamima on charges of entrapping a non-resident Indian (NRI) in a fraudulent online relationship, drugging him, extorting money, and threatening to disseminate compromising photographs. The NRI claims he met Jamima on Instagram, where they developed a rapport. He alleges that Jamima professed her love and even visited his parents' home in Sheelanagar, posing as a friend. However, the NRI's parents were unaware of their online relationship. According to the complaint, Jamima lured the NRI and drugged him using drinks and juices. She allegedly took compromising photos of him while he was unconscious and threatened to post them online unless he agreed to get engaged. Fearing for his reputation, the NRI claims he was coerced into an engagement at a hotel in Bhimili, which cost him over Rs. 5 lakh. The NRI further alleges that Jamima forced him to stay at her home in Muralinagar, confiscated his phone, and threatened him with physical abuse if he did not comply with her demands. He claims she also threatened to spread the compromising photos and file false police cases against him to prevent his return to America. On October 4, the NRI managed to escape from Jamima's house and approached the Bheemli Police Station. A case has been registered under various sections of the Indian Penal Code (IPC). Police have arrested Jamima and seized electronic devices, including a laptop, a tablet, three mobile phones, and a car believed to be linked to the alleged crimes. A search of her residence in NGO Colony, Muralinagar, was also conducted. Jamima has been sent to judicial remand and is currently in central jail.

SC Ruling on NRI Quota Sparks Uncertainty for Medical College Admissions in Telangana
Hyderabad: Some NRI-sponsored candidates aspiring for admission in Telanganas private medical colleges were in for tense times after the Supreme Court observations observations on Tuesday. While hearing an appeal from the Punjab government seeking to expand the NRI quota to candidates who are close relatives of NRIs, the Supreme Court remarked that the NRI quota business needs to end due to the risk of misuse. On September 10, the Punjab and Haryana High Court had set aside the AAP-led government's August 20 notification that expanded the NRI seat category to include distant relatives of candidates such as uncles, aunts, grandparents, and cousins for admission under the 15 per cent NRI quota to medical and dental courses. While hearing the appeal, a Supreme Court bench comprising Chief Justice D.Y. Chandrachud, Justice J.B Pardiwala and Justice Manoj Misra noted: Candidates with much higher marks will lose seats, and others will get in through the backdoor. The bench also noted that most applicants under the expanded NRI definition were actually residents of India. We should not support something that is clearly a fraudulent category, the CJI added. This could affect NRI quota seats in Telangana as well. According to the KNRUHS prospectus for admissions into MBBS courses under management quota in private un-aided medical colleges, candidates can use the NRI quota if sponsored by blood relatives, including parents, siblings, or even an uncle or aunt. However, the Supreme Court ruling clarified that uncles and aunts cannot sponsor candidates. The court has expressed concern over the misuse of these categories. According to the university prospectus, there is no mechanism to verify the blood relationship in such cases. Deccan Chronicle attempted to contact the Vice Chancellor and Registrar of the health university for clarification but they were unavailable. In most private colleges, medical seats under NRI quota are the most-sought after seats as the colleges can convert them into Management quota and offer them to Indian residents. Colleges can charge the NRI quota fee from these candidates, said Kiran Madhala, national coordinator for All India Federation of Government Teaching Doctors.

NEW DELHI: The Supreme Court on Tuesday dismissed the Punjab government's appeal against a high court verdict quashing its decision to expand the definition of 'NRI quota' for admissions in undergraduate medical and dental courses in the state. This fraud must come to an end now, the apex court said. On September 10, the Punjab and Haryana High Court trashed the AAP-led state government's August 20 move extending the ambit of the NRI quota to include distant relatives such as uncles, aunts, grandparents, and cousins of NRIs for admissions under 15 percent quota for this group in admissions in medical colleges. This is nothing but a money spinning machine, observed a bench of Chief Justice D Y Chandrachud and Justices J B Pardiwala and Manoj Misra. We will dismiss all the petitions. This NRI business is nothing but a fraud. We will put an end to all this. Now the so called precedents must give way to primacy of law, said the bench. Terming the high court verdict absolutely right, the court said, Look at the deleterious consequences. The candidates who have three times higher marks will lose admission (in NEET-UG courses). The top court said distant relatives of a 'mama, tai, taya', who are settled abroad, will get admissions ahead of meritorious candidates and this cannot be allowed. This is completely a fraud. And this is what we are doing with our education system ! We will affirm the high court judgement. We must stop this NRI quota business now. The judges know what they are dealing with. The high court has dealt with the case threadbare, the CJI said. Let us put a lid on this. What is this ward? You just have to say that I am looking after X . We cannot lend our authority to something which is blatantly illegal, the bench said while dismissing the plea of the state government. Senior advocate Shadan Farasat, appearing for the Punjab government, said that other states like Himachal Pradesh, Uttar Pradesh also followed the broader interpretation of term 'NRI quota'. Moreover, the states have the power to decide as to how 15 per cent NRI quota has to be granted. Out of total NEET-UG seats, 85 per cent seats in medical colleges are filled up by the states in medical colleges under their jurisdiction, the counsel, in favour of NRI quota, told the bench. The bench said now the central government will have to take note of this as well. A division bench of the high court had come out with an elaborate judgement trashing the state government decision to broaden the ambit of NRI quota for admissions in Punjab medical colleges. The high court took note of the submissions that the decision to widen the ambit of NRI quota was taken to divert the seats which would have otherwise come to the general category applicants. Imparting education is not an economic activity but a welfare-oriented endeavour as the ultimate aim is to achieve an egalitarian and prosperous society in order to bring about social transformation and upliftment of the nation. Doctrine of merit and fairness cannot be sacrificed only because the students falling in the expanded definition of Non-Resident Indian (NRI) possess financial muscle. Capitation fee has totally been prohibited. If the admissions in the expanded NRI category to include non-genuine NRIs are permitted; the prohibition made on charge of capitation fee would serve no higher purpose, as the State/private colleges would be at liberty to reap the benefits by amending the provisions according to their whims, which means accepting it by disguising the process, the high court said. The expansion of 'NRI' definition through the state government corrigendum is unjustified for several reasons, the high court said. Initially, the 'NRI Quota' was intended to benefit genuine NRIs and their children, allowing them to access education opportunities in India. By broadening the definition to include distant relatives such as uncles, aunts, grandparents, and cousins, the core objective of NRI quota is undermined. This widening opens the door for potential misuse, allowing individuals who do not fall within the original intent of the policy to take advantage of these seats, potentially bypassing more deserving candidates, it said.
