Rule tweak cuts access to certain poll documents
NEW DELHI: In a move that drew sharp criticism from the Opposition parties and RTI activists, the Centre on Friday amended the Conduct of Election Rules to prevent public scrutiny of certain electronic documents such as CCTV footage and video recordings of polling. Based on the Election Commissions (EC) recommendation, the Union Law Ministry amended Rule 93 of the Conduct of Election Rules, 1961, to restrict certain documents that were to public inspection till now. Rule 93(2)(a) earlier stated that all other papers relating to the election shall be open to public inspection. The amended version says all other papers as specified in these rules relating to the election shall be open to public inspection. Acting upon a complaint filed by advocate Mehmood Pracha, the Punjab and Haryana High Court has recently directed the EC to provide videography, security camera footage, and copies of documents related to votes polled at a polling station during the recent Haryana assembly elections. Pracha had sought video and CCTV footage, and copies of Forms 17-C Parts I and II related to the polls. Coming down heavily on the amendment, the Congress said it would challenge it in court. In a post on X, Congress general secretary Jairam Ramesh said that the tweak was a vindication of its assertions regarding the rapidly eroding integrity of the electoral process managed by the Election Commission in recent times. For their part, the Law Ministry and EC officials said documents such as nomination forms, appointment of poll agents, results and election account statements are mentioned in the Conduct of Election Rules, but electronic documents such as CCTV footage are not. There have been instances where such electronic records have been sought, citing the rules. The amendment ensures that only papers mentioned in the rules are available for public inspection, an EC official said. He added that the misuse of CCTV footage from inside polling booths could compromise voter secrecy and could be used to generate fake narratives using AI. NEW DELHI: The proposal for tableau of the Delhi Government for Republic Day 2025 was not approved by the expert committee. The tableaus from 15 States and Union Territories have been selected for next years January 26, told the defence sources. The tableau selection in the past has been drawing controversy keeping which this year the Defence Ministry has proposed a roll-over plan for States and UTs to showcase their tableaux. A three-year agreement was signed for 2024, 25 and 26 under which every State and UT would get a chance to present atleast once during the three years, said sources. As for selection The expert committee looks into various aspects of theme, concept, designs and visual elements. Out of the original 15 selected, the expert committee didnt approve the tableau proposal of Delhi, the source added. Coming to the Delhi Government's proposal, the reason behind it not getting selected is not immediately known. While in the two decades Delhi has presented tableau seven times, Gujarat and Uttar Pradesh were selected again. On it, the sources said that there were several States that in the last two decades presented more number of times than the former two. Jammu and Kashmir, Karnataka, Chhattisgarh Maharashtra and Assam have been represented multiple times. The tableau selection process ahead of RD parade 2024 had drawn controversy as Delhi, Punjab and Karnataka had alleged discrimination as their proposals were rejected. The screening committee under the Ministry of Defence follows an elaborate screening mechanism to select participants for the parade. The expert committee is comprised of artists and Padma awardees representing various fields. It is this committee that decides on the theme, aesthetics and criteria and screens proposals from various from States, UTs and Government departments.

New Delhi: The government has tweaked an election rule to prevent public inspection of certain electronic documents such as CCTV cameras and webcasting footage as well as video recordings of candidates to prevent their misuse.Based on the recommendation of the Election Commission (EC), the Union law ministry has amended Rule 93 of the Conduct of Election Rules, 1961, to restrict the type of papers or documents open to public inspection. According to Rule 93, all papers related to elections shall be open to public inspection. The amendment inserts as specified in these rules after papers. Law ministry and EC officials separately explained that a court case was the rigger behind the amendment. While documents such as nomination forms, the appointment of election agents, results, and election account statements are mentioned in the Conduct of Election Rules, electronic documents such as CCTV camera footage, webcasting footage, and video recording of candidates during the Model Code of Conduct period are not covered. There have been instances where such electronic records have been sought, citing the rules. The amendment ensures that only papers mentioned in the rules are available for public inspection and any other document which has no reference in the rules is not allowed for public inspection, an EC functionary said. EC functionaries said the misuse of CCTV camera footage from inside polling booths could compromise voter secrecy. They also said the footage could be used to generate fake narratives using AI. All such material is available to candidates, including footage. After the amendment, too, it will be available to them. But other people can always approach the courts to get such electronic records, said another functionary. Punjab and Haryana High Court had recently directed the EC to provide copies of the required documents related to the Haryana Assembly elections to advocate Mehmood Pracha. He had filed a petition seeking the videography, CCTV camera footage, and copies of Forms 17-C Parts I and II related to the conduct of elections.

This was done in consultation with the EC, Siasat.com reported. While earlier Rule 93(2)(a) of the 1961 Conduct of Election Rules stated that all other papers relating to the election shall be open to public inspection, the amended version now says, all other papers as specified in these rules relating to the election shall be open to public inspection. This implies that the public can get access to documents specified in the Conduct of Election Rules. Activists, according to Deccan Herald , claimed that the insertion of as specified in these rules restrict access to a range of official documents created during the elections to Parliament and Assemblies, which are not specified in the rules.

Ahead of the 2025 Delhi Assembly elections, Delhi Lieutenant Governor VK Saxena has reportedly approved the Enforcement Directorate's request to prosecute AAP Chief and former Delhi Chief Minister Arvind Kejriwal in the excise policy case, according to news agency ANI . AAP, however, has called the reports as false and misleading and asked the ED to show the copy of the sanction given by the Lt Governor. On December 5, the Enforcement Directorate had sought permission for sanction of prosecution against Arvind Kejriwal. This move comes after months of investigations into the Delhi government's excise policy, which has been at the center of controversy and allegations of corruption. Meanwhile, the Delhi High Court on Friday granted the Enforcement Directorate (ED) additional time to file its reply to the petition filed by Arvind Kejriwal and Manish Sisodia . The petition challenges the trial court's decision to take cognizance of the chargesheets in the Delhi Excise Liquor Policy case. The matter has been scheduled for hearing on February 5, by the bench of Justice Manoj Kumar Ohri. Recently Delhi High Court had issued a notice on Aam Aadmi Party' leader Arvind Kejriwal and Manish Sisodia's plea challenging the trial court's decision to take cognizance of the Enforcement Directorate's chargesheet against them in the alleged excise policy scam. Arvind Kejriwal and Manish Sisodia are currently out on bail in both the Enforcement Directorate (ED) and Central Bureau of Investigation (CBI) cases related to the now-scrapped excise policy. According to the Enforcement Directorate (ED), the Excise Policy was deliberately designed with loopholes to benefit AAP leaders and foster cartel formations. The ED accused AAP leaders of receiving kickbacks from liquor businesses in exchange for preferential treatment, including discounts, license fee waivers, and relief during the Covid-19 disruptions. The ED further alleged that the scam involved awarding wholesale liquor distribution rights to private entities with a fixed 12% margin, in return for a 6% kickback. CHANDIGARH: An explosion-like sound heard outside the Wadala Bangar police chowki in Punjab's Gurdaspur district triggered panic in the area, prompting police to launch an investigation, officials said on Saturday. This is the third such incident in the past seven days. A blast occurred at the Islamabad police station in Amritsar on December 17. No one was injured in it. The Gurdaspur incident occurred around 9.30 pm on Friday, according to the officials. They said local people heard the explosion-like sound and informed police. However, police said nothing was found at the spot that could indicate an explosion took place. Senior police officials, including Gurdaspur Senior Superintendent of Police (SSP) Dayama Harish Kumar Om Prakash and Superintendent of Police (SP) Jugraj Singh, visited the spot. After some locals informed the deputy superintendent of police, information was also received by the control room. Senior officers reached the spot immediately, Kumar said. The civic polls will be a litmus test for the ruling Aam Aadmi Party (AAP), which would like its winning momentum to continue after securing victories in three of the four Assembly bypolls in November. These elections are important as they will reveal the popularity of the ruling party among urban voters. Chief Minister Bhagwant Mann held roadshows and campaigned for the AAP candidates in the run-up to the elections. It will also be the first test for Aman Arora after he was appointed as the AAP's Punjab unit chief. Arora took part in poll campaigning and made several promises to the voters. The stakes are also high for the Congress, which had majority in the Amritsar, Jalandhar, Ludhiana and Patiala municipal corporations. NEW DELHI: For the Mahakumbh at Prayagraj, a culture village, called Kalagram, will be set up on over 10 acres at Daraganj along the banks of the Ganga and it will have demarcated spaces for seven zonal cultural centres (ZCC), officials said. The marked areas are named aangans (courtyards), where the ministry of culture plans to showcase art and crafts from all member states and union territories (UT). Exhibitions on the theme of Kumbha, including an immersive display, food court, and activity areas will also be put up at the venue. The ambience creation of Kalagram will be done by an expert private agency in collaboration with artists of ZCCs and Lalit Kala Akademi. The participating ZCCs are located in Patiala (Punjab), Nagpur (Maharashtra), Udaipur (Rajasthan), Prayagraj (Uttar Pradesh), Kolkata (West Bengal), Dimapur (Nagaland), and Thanjavur (Tamil Nadu). According to the officials, diverse art installations, including cultural, educational, and commercial exhibits, are also planned for an engaging visitor experience. Union tourism culture minister Gajendra Singh Shekhawat earlier told this newspaper that a cultural extravaganza, showcasing the vibrant and colourful customs, arts and crafts of the states, is planned at Mahakumbh starting January in Prayagraj. After the consultation with the Uttar Pradesh government, the ministry has got prime space allocated close to the main Mahakumbh Mela venue so that more visitors can witness the festivities, Shekhawat said. The authorities have also planned to place an installation on the proposed Yuge Yugeen Bharat Museum at the venue. One of the highlights at Kalagram will be a Ganga pandal with capacity of 10,000 audiences by the Mela Authority. This will be the main arena, where celebrity performances will be held everyday. Additionally, three pandals with a space for 4,000 people will be erected at Jhunsi, Nagvasuki and Areil. There will also be another amphitheatre of 1,000 capacity at Kalagram, where Snageet Natak Akademi awardees artists, National School of Drama productions and ZCC ensembles will be organised, an official said. Apart from this, 20 stages will also be built throughout the city. They will be handed over to the UP culture department and the ministry of culture, the official added. Meanwhile, the Indian Railways is gearing up to redefine the Mahakumbh experience with an innovative Gram Tent City initiative in Prayagraj. The Mahakumbh, scheduled from January 14 to February 2025, is set to blend spirituality with modernity, providing a unique experience for millions of pilgrims. The Mahakumbh Gram Tent City plan, launched by IRCTC, aims to deliver a seamless and memorable experience for visitors.

Jagjit Singh Dallewal, the farmers leader who is on a fast unto death, on Friday wrote a letter requesting the Supreme Court to direct the Centre to honour the recommendations of the Parliamentary Standing Committee on Agriculture. The letter urged the apex court to ask the Union Government to respect the sentiments of farmers and enact a law for Minimum Support Price (MSP) as suggested by the Committee and also meet other farmer demands as soon as possible. The letter written under the letter head of the Samyukta Kisan Morcha and Kisan Mazdoor Morcha and signed by Dallewal reads: Today marks the 25th day of my hunger strike as part of the ongoing movement led by the SKM (Non-Political) and Kisan Mazdoor Morcha for 13 demands, including the MSP guarantee law. I have learned from the news that you are deeply concerned about my health, and I respect your sentiments. However, I humbly request you to prioritise the lives of farmers who committed suicide due to the governments misguided policies over my own life. Earlier, only farmers and agricultural laborers demanded the MSP guarantee law. Now, even the Parliament's Standing Committee on Agriculture has emphasised in its report (Volume 1, Point 7, Page 54) that such a law should be enacted. This will greatly benefit farmers, the rural economy, and the country. The MSP guarantee law will enhance farmers purchasing power, significantly benefiting the national economy. This recommendation comes from an all-party parliamentary committee, which includes 31 MPs representing all political parties. Why farming is more important than IT to India's economy and why MSP reforms shouldn't wait Dallewal further stated: I request you to issue necessary directions to the central government to enact the MSP guarantee law in line with the parliamentary committees report and the sentiments of farmers. This will help prevent farmer suicides. I also want to draw your attention to the fact that the issues we are protesting are not merely demands but promises made by various governments. In 2011, Prime Minister Narendra Modi, then Chairman of the Consumer Affairs Committee and Chief Minister of Gujarat, sent a report to the then Prime Minister Dr Manmohan Singh, recommending that no trader should purchase crops below the MSP set by the government and that a law should be enacted for this. However, after coming to power in 2014, PM Modi has yet to implement his own recommendation. How real is our farmers' angst? Broken promises The Dr Swaminathan Commission, formed in 2006 to address farmer suicides, submitted its report to the UPA government, but it was not implemented. During the 2014 Lok Sabha election campaign, PM Modi promised to determine crop MSPs based on the C2+50% formula of the Swaminathan Commission. However, this promise remains unfulfilled, the letter noted. When we suspended our 378-day agitation in 20202021, the Union Agriculture Ministry handed us a letter on December 9, 2021, containing several written commitments. These included ensuring MSP for all farmers, exempting farming activities from pollution laws, providing proper compensation to the injured in Lakhimpur Kheri, consulting farmers before presenting the Electricity Bill in Parliament, and withdrawing cases against agitating farmers. None of these promises have been implemented so far, it went on to add. Health condition remains serious Doctors monitoring Dallewal's health have reported that his condition is critical, and he refrained from meeting anyone on Friday. I will continue on this path until my last breath, he said. Meanwhile, the Supreme Court has directed the Punjab government to move the fasting farmer leader to a nearby makeshift hospital at the Khanauri border for round-the-clock health monitoring. Many farmers, in solidarity with Dallewal, staged a symbolic hunger strike. Farmers from neighboring Haryana, under the banner of Bhartiya Kisan Union (BKU-Charuni), fasted in Kaithal to express their support for Dallewal. The health condition of Dallewal is serious. The Union Government should hold talks with the protesting farmers and accept their demands. These include fulfilling promises made in December 2021, particularly the legal guarantee of MSP on all crops. Failure to do so has left farmers feeling betrayed, said Vikram Kasana, State President of BKU (Charuni).

Some weeks ago, former Punjab deputy chief minister Sukhbir Singh Badal, undergoing religious penance at the holy Harmandir Sahib in Amritsars Golden Temple, survived an assassination attempt on his life when a former ageing Khalistan terrorist, Narain Singh Chaura, fired at him. Thanks to an alert police sub-inspector, Mr Badal was saved as the round went astray. While the Punjab police successfully thwarted the attempt on Sukhbirs life, a can of controversies has opened up on the motive behind this unexpected event. Many conflicting theories have emerged at this unfortunate occurrence inside the shrine in full view of the Punjab police, who were fully conversant with the infamous history and whereabouts of the alleged would-be assassin. All plausible angles on this event need serious introspection, including those pointing to personal enmity or the Khalistan angle to it, or as some in the Punjab Police claim, the possible staged-management of this event to garner sympathy for the fading fortunes of the Shiromani Akali Dal. As the police and other security agencies delve deeply into the nuances of this crime, it will be in the larger security interests of the nation to analyse any Khalistan conspiracy angle. The fact remains that though Indias most strategic border state of Punjab is relatively peaceful, with no inter-societal or internal security problems, yet the mischief played in the 1980s by the rogue state of Pakistan in Punjab cant be taken lightly and the careful, regular monitoring of the activities in Punjab of Pakistans Inter-Services Intelligence must be ensured. It must also be accepted by our political and security establishment that there has been, in recent years, a discernible rise in sympathy for the Khalistan secessionist movement among Indias Sikh diaspora with some support from the governments of Canada, and to a lesser extent from that of the United States and Britain. These governments claims about freedom of speech and allowing protests in their societies fails to stand scrutiny as some in the Indian diaspora have misused these freedoms to vandalise temples and target Indian diplomatic missions. What is amply clear is that Pakistans ISI appears to have revived its K2 (Kashmir and Khalistan) strategy, which was pioneered by military dictator Gen. Zia-ul Haq in the early 1980s when he realised it was impossible to otherwise wrest Jammu and Kashmir from India and foment a credible separatist movement in Indias Punjab. That in both places the patriotic people of Punjab and even the Kashmiris had not succumbed to Pakistani machinations is a historical fact. India also cannot forget that, to some extent, Sikh extremism did occur in Punjab in the 1980s, while terror attacks do take place in J&K at times triggered by Pakistani agents. In both Punjab and J&K, however, the overall security situation is normal. Since Independence, barring short interludes during the time of Prime Minister Liaqat Ali Khan (later assassinated) and for around three years when Gen. Pervez Musharraf was both Chief of Army Staff and President, Pakistan with its myopic and self-destructive policies has maintained an anti-India policy in all its politico-strategic formulations. The K2 dream still persists in their mindset and that of the Sikh diaspora, and even Sikhs in Punjab continue to be targeted by the ISIs propaganda machinery. India, therefore, has to ensure through a whole of nation approach to counter these designs by Pakistan and some other countries, such as Canada. The Sikhs are among the most patriotic, gallant and industrious communities of India, who whenever given a chance, will raze to the ground any anti-India elements. The Indian government, however, has to implement a well-thought-out strategy to counter the anti-India propagandas both at home and abroad. Sooner rather than later, India must send out delegations comprising eminent Sikhs from different walks of life in India to the Western nations where the Sikh diaspora resides. These delegations should re-educate those affected Sikh elements regards the commonality and blood relationship of the Hindu and Sikh faiths and for them not to succumb to the evil machinations of Pakistani or other foreign agents. The sacrifices of our Sikh brethren in preserving the integrity of India must be given its rightful share in our history. The genuine problems and aspirations of the farmers, a large number of whom are Sikhs, should be sympathetically addressed by the government with alacrity. The Sikh diaspora often gets unnecessarily agitated over farmers issues in India. Regarding the assassination bid on Sukhbir Badal, the Punjab police investigating the case, the Badal family and the SGPC are locked in a verbal war on the reasons behind the assassination bid. CCTV footage shows that Narain Singh Chaura and two accomplices had carried out a recce of the Golden Temple premises a day earlier and Mr Badals brother-in-law, Bikram Majithia, has alleged that the SGPC president had hugged Narain Singh before the shooting incident and thus asked the SGPC to release the entire CCTV footage. The Punjab police feels that it may be a lone wolf incident, whereas the Badal family thinks that there is a deeper conspiracy. It will ultimately be prudent for the Central government to go deep into this incident and have a reputed outfit like the National Investigation Agency probe the case. A simmering Khalistan emergence abroad exists -- for the time being and thus it will be prudent for Indias security and intelligence establishment to keep a strict watch inside Punjab for India cannot afford to have a re-enactment of the conditions in Indias crown jewel state of Punjab as had taken place in the mid-1980s.

NEW DELHI: The Supreme Court on Friday asked the Punjab government to shift fasting farmer leader Jagjit Singh Dallewal to a nearby makeshift hospital at the Khanauri border where his health can be monitored round-the-clock. A bench of Justices Surya Kant and Ujjal Bhuyan asked the Punjab government Advocate General Gurminder Singh to file an undertaking during the course of the day about shifting the 70-year-old Dallewal to the makeshift hospital setup near the protest site at Khanauri border between Punjab and Haryana. Singh informed the bench that on Thursday the farmer leader has cooperated and underwent several tests, including ECG and blood tests. He said that Dallewal's health condition appears to be stable as of now. The bench said it will take up the matter again at around 2.30 pm. On Thursday, the bench referred to civil rights activist Irom Sharmila continuing her protest for more than a decade under medical supervision and asked the Punjab government to convince Dallewal to undergo a health examination. It had pulled up the Punjab government for not conducting medical tests on Dallewal, who is on an indefinite fast. Dallewal has been on an indefinite fast at the Khanauri border since November 26 to press the Centre to accept the agitating farmers' demands, including a legal guarantee of minimum support price (MSP) for crops. Farmers under the banner of Samyukta Kisan Morcha (non-political) and Kisan Mazdoor Morcha have been camping at Shambhu and Khanauri border points between Punjab and Haryana since February 13 after their march to Delhi was stopped by the security forces.
