HC orders 4-week interim stay on Punjab land pooling policy; seeks clarity on rehab provisions

CHANDIGARH: The Punjab and Haryana High Court has put a four-week interim stay on the implementation of the controversial land pooling policy of the Punjab Government. The court made clear its intent to stay the policy after the government refused to withdraw it. The division bench of Justice Anupinder Grewal and Justice Deepak Manchanda also gave the state four weeks time after hearing detailed arguments for about two hours. We will stay the policy and give you time to address the concerns, the court said. The state has also been directed to inform the court whether a social impact assessment was carried out before notifying the policy. The court reiterated its concerns regarding the lack of provision for the rehabilitation of landless labourers and others dependent on land for their sustenance. It also questioned the government for not conducting the compulsory social impact assessment before identifying the land to be acquired. Earlier, the petitioner Gurdeep Singh Gill had contended that the policy was an act of colourable legislation, allegedly framed under a Central law that contained no enabling provision for such a scheme. His counsel Gurjeet Singh Gill, Manan Kheterpal, Manat Kaur, Rahul Jadge, and Rajat Verma also sought directions for quashing the notification and the policy as ultra vires, arbitrary, and violative of Articles 14, 19(1)(g), and 21 read with Article 300-A of the Constitution. After the hearing, Gurjeet Singh, lawyer of Gill, said that neither a social impact assessment nor any environment-related assessment was carried out under the land pooling policy. That no such social impact assessment report was either prepared or published, as per the provisions of law. Moreover, none of the gram panchayats or gram sabhas were approached or consulted by the respondents before bringing the Land Pooling Policy 2025, which is a clear disregard of the provisions mandated under the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013, said the petition. It further added that since there was no such provision of law under the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013, to frame the Land Pooling Policy 2025, there lies no mechanism or forum to challenge such a policy and the petitioner is left with no remedy to redress his grievance. On August 6, the court asked the Punjab government whether there was any provision in the policy for the rehabilitation of landless labourers for their sustenance. The Aam Aadmi Party-led Punjab government has been facing flak from opposition parties and various farmer unions, which have termed the policy a looting scheme to rob the farmers of their fertile land. Meanwhile, the Bharatiya Janata Party (BJP) announced a state-wide yatra titled Save Land, Save Farmers, from August 17 to September 5. BJPs state Vice President Kewal Singh Dhillon said that during this yatra, BJP Punjab will go village-to-village creating awareness among farmers against this scheme and mobilising them. The yatra will kick off on August 17 from Patiala and pass through villages in the Malwa, Majha, and Doaba regions affected by the land pooling plan, culminating in Pathankot on September 5. Also, the Shiromani Akali Dal (SAD) has announced the launch of an indefinite Morcha from September 1. Party President Sukhbir Singh Badal said that the Morcha is dedicated to safeguarding Punjabs farmers, khet mazdoor, traders, and other sections of Punjabi society. He also announced that the party was unanimous in its decision to revoke the land pooling scheme after taking over the reins of the state in 2027, in case the AAP government persisted with its nefarious designs. We will hand over the entire acquired land back to the farmers after forming a special law for the purpose, in the same manner in which the land on which the Sutlej Yamuna Link (SYL) canal was handed back to the original owners by Parkash Singh Badal in 2016, he said. Badal will lead the first Jatha on September 1 from Amb Sahib Gurudwara in Mohali and march to the new Sheesh Mahal at the nearby Panchayat Bhawan. Party workers from each constituency in Punjab will subsequently participate in a continuous dharna and march from the same site in Jathas of 500 persons each, indefinitely, till the AAP government revokes the land pooling scheme. Punjab police foils Pak-backed terror plot, seizes IED and arms ahead of Independence Day

CHANDIGARH: Ahead of Independence Day celebrations, the Anti-Gangster Task Force (AGTF) of Punjab Police foiled a major terror plot orchestrated by Pakistan-based terror organization Babbar Khalsa International and recovered an improvised explosive device (IED). Punjab Police Director General Gaurav Yadav stated that acting on credible intelligence about an IED consignment pushed from Pakistan, AGTF teams, along with Tarn Taran Police, launched a joint operation in Tarn Taran district. The IED was recovered from Naushera Pannuan and was intended for delivery to associates of militants Rinda and Landa. After seizure, the Explosive Ordnance Disposal (EOD) team successfully neutralized the device in a controlled detonation. Additional Director General of Police (AGTF) Promod Ban revealed that preliminary investigations indicated the IED was pushed into Punjab by Pakistani agency-backed terror modules aiming to disrupt public peace and target innocent lives in the border state. Deputy Inspector General (DIG) AGTF Gurmeet Singh Chauhan confirmed that a case has been registered under Sections 3, 4, and 5 of the Explosive Substances Act and Section 111 of the Bhartiya Nyaya Sanhita at Police Station Sirhali in Tarn Taran. DGP Gaurav Yadav stated that the accused were in contact with Pakistan-based smugglers and had been receiving illegal weapon consignments near the Indo-Pak border. The arrested individuals operated from border villages and supplied arms to gangsters across the state, he added, noting that further investigations are underway to dismantle the network. Amritsar Police Commissioner Gurpreet Singh Bhullar shared operational details, stating that enhanced security measures ahead of Independence Day led to the arrests. Acting on specific inputs, police teams apprehended Akash and Raman from Chheharta Police Stations jurisdiction, recovering four pistols (two PX5 9mm and two .30 bore). Later, their accomplices Pratap and Sarbjeet were arrested from the same area, with three more pistols seized. Bhullar added that Akash, residing near the International Border, and Raman received arms consignments from across the border, while Sarbjeet and Pratap coordinated supply operations. This arrest has averted major criminal activity in the area, he said, confirming ongoing probes with more arrests likely. Punjab Womens Commission summons singers Karan Aujla, Yo Yo Honey Singh over lyrics allegedly demeaning women

CHANDIGARH: The Punjab State Womens Commission has taken suo motu cognisance of the objectionable language allegedly used by singers Karan Aujla and Yo Yo Honey Singh in their latest songs Millionaire and MF Gabru , which are currently trending on social media. The commission has directed the Punjab Police to investigate the matter and take appropriate action. In a formal complaint lodged with the state police, the commissions chairperson, Raj Lali Gill, has written two letters to the Director General of Police, Punjab, Gaurav Yadav, demanding a proper probe into the two songs, which she said allegedly demean the dignity of women. She has also asked that a senior officer be deputed to investigate the matter and that a report be submitted to the commission by August 11. Further, both singers have been summoned to appear at the commissions office on the same day. Gill said the commission had come across the songs MF Gabru by Karan Aujla and Millionaire by Yo Yo Honey Singh, and noted that they allegedly contained objectionable language directed against women and were being widely circulated on social media. Those who use such language cannot be tolerated. The singers are the voice of society. On one hand they say they love their mother and on the other hand they use such abusive language for mothers in their songs, she said. The commissions intervention signals growing concern over controversial lyrics in Punjabi music, which are frequently criticised for vulgar and violent content. It also underscores the commissions role in safeguarding the rights, dignity and status of women across the region. It is not the first time that rapper Yo Yo Honey Singh has found himself embroiled in controversy over his lyrics. He has faced similar criticism in the past for songs that have often been accused of objectifying women. Karan Aujla, meanwhile, is a rising star in the Punjabi music scene. His song MF Gabru is one among several that have generated massive attention.

Calcutta HC says judges shouldn't be bloodthirsty, commutes death sentence to life term in murder case

KOLKATA: Observing that judges should never be loodthirsty, the Jalpaiguri Circuit Bench of the Calcutta High Court has ordered commutation of the death sentence of a man to life imprisonment for the murder of his maternal uncle. Passing the judgment, Justice Sabyasachi Bhattacharyya said that the evolution of society has been towards a reformative approach towards penology, as opposed to a retributive approach. There are three cardinal pillars of punishment -- retribution, deterrence and reformation. Whereas deterrence still holds good as a justification, retribution has gradually given way to the reformatory aspect of penalties in modern criminal jurisprudence, both in India and elsewhere, the court said. Justice Bhattacharyya commuted the death sentence awarded to Aftab Alam by the Jalpaiguri sessions court for committing offence under Section 396 (dacoity with murder) to life sentence for the rest of his life, without any option of premature release for 20 years, unless exceptional circumstances are made out to the satisfaction of the court concerned. Judges should never be bloodthirsty. Hanging of murderers has never been too good for them, Justice Bhattacharyya observed. Upholding the conviction of Alam by the trial court for the murder of his maternal uncle at Dhupguri in Jalpaiguri district on July 28, 2023, while committing dacoity at his house along with five other associates, Justice Bhattacharyya, while passing the judgment earlier this week, said that the crime does not fall under the 'rarest of the rare' category. Noting that in a landmark judgment in 1980 by the Supreme Court in the Bachan Singh versus State of Punjab case, a word of caution was put in, to the effect that judges should never be bloodthirsty. The alteration of the names of jails from 'prisons' to 'correctional homes' in recent times is for a reason, reflecting the transition from the basic bloodthirsty instinct of society to take revenge to a more civilised policy of attempting to reform the accused, on the principle that one should hate the offence and not the offender, Justice Bhattacharyya observed. He said that there has been a debate around the world as to the retention of the death sentence as a punishment, however heinous and grave the offence may be. The anti-death penalty camp argues that if deterrence is taken to be a reason for punishment, a lifetime of imprisonment is as good as a death sentence. Rather, a lifetime behind bars, which denudes the convict of his freedom for his entire life, is a preferable form to punish him than death, which takes place in a flash, he noted. Justice Bhattacharyya observed that, pitting the pros and cons against each other, if a person is hanged or otherwise killed by dint of a death penalty, the damage done is irreversible. He said that even if subsequently some new light is shed on the investigation or there is discovery of some new evidence or something to justify the reopening of the investigation, here would be no chance of bringing back a life which has already been taken; thus, the death penalty is irreversible. Alam's lawyer argued that there was no evidence to show that the murder was pre-planned or cold-blooded or to conclude that the same fell under the category of arest of the rare cases and that the trial judge did not consider the possibility of reformation at all. The additional public prosecutor, appearing for the state, contended that the crime was established beyond doubt and prayed that the capital punishment awarded to the appellant by the trial court be upheld. Holding that the court finds no evidence adduced by the state that the convict is beyond reform, Justice Bhattacharyya said that the young age of Alam, who is in his twenties, is another mitigating factor which precludes awarding the death sentence. Noting that Alam was residing at Delhi for a long time after leaving his maternal uncle's house at Dhupguri, where he had earlier stayed for some years, the high court said that the position of trust approach cannot be applied, since at the time of the offence, the appellant was long gone from the shelter of his uncle. It noted that the etrayal angle, per se, does not justify the death penalty.

The policy has also been challenged in Punjab and Haryana High Court. On the other hand, the government claims that many farmers have agreed to follow this policy and give up their lands. However, compared to the protesting farmers, the number of farmers complying is very less: only 115 land owners in total (15 from Ludhiana and 100 from Mohali) have come forward to adopt the scheme since it was launched on June 2. As per the policy the state government plans to acquire 65,533 acres of land across 21 cities and towns in the state to develop both industrial and residential zones. The move is said to be the largest acquisition of land by the Punjab government since 1966. Partially relenting to the protest, the government has decided to implement the policy only in Ludhiana, Patiala and Mohali while putting smaller towns on hold. Last week, CM Mann said his government would continue engaging with farmers, calling their consent and their consent would remain pivotal to the land pooling policy. CHANDIGARH: The latest round of talks between Punjab Chief Minister Bhagwant Mann and his Haryana counterpart Nayab Singh Saini on the long-pending Sutlej-Yamuna Link (SYL) Canal dispute ended without resolution. This was the fifth meeting between the two leaders, with the Supreme Court set to hear the case on August 13. The discussions, held during a meeting convened by Union Jal Shakti Minister CR Patil, saw Mann proposed an alternative solutionutilising water from the Chenab River to address the water-sharing conflict between Punjab and Haryana while shelving the SYL canal project. Mann said that the suspension of the Indus Water Treaty with Pakistan presents an opportunity for India to harness water from the Chenab, a western river previously allocated to Pakistan. He urged the Centre to divert Chenabs water to Indian dams like Ranjit Sagar, Pong, and Bhakra, emphasizing the need for new canals and infrastructure in Punjab. According to Mann, this water could first meet Punjabs needs before being supplied to Haryana and Rajasthan, reducing Punjabs groundwater dependence and supporting its agrarian economy. The Punjab CM also uphold for the Sharda-Yamuna Link (SYL alternative) to transfer surplus Sharda water to the Yamuna, eliminating the need for the SYL canal. He further called for a review of the 1994 Yamuna water-sharing agreement between Delhi, Uttar Pradesh, Himachal Pradesh, and Rajasthan post-2025. Haryana CM Nayab Singh Saini, however, described the talks as constructive, expressing optimism about a fair resolution. He assured that Haryana would present its case positively before the Supreme Court. Saini said that the issue has been under discussion for a long time, and earlier deliberations held on July 9 had already indicated a positive shift. This time, we have moved a step further. `` The discussions were held in an even more constructive environment, he said. He assured that Haryana will present its case in a positive and solution-oriented manner before the Supreme Court on August 13. `` We are confident that a fair and favourable resolution will be achieved, he added. In response to a question, Saini said that the Indus Waters Treaty is a separate subject, and under that context, Rajasthan will also be entitled to its share of water. SAD leader Dr. Daljit Singh Cheema reiterated Punjabs stance of having no surplus water to share and demanded clarity from the AAP government on keeping the two issues separate. We can talk about the Indus Water Treaty and its effect on Punjab as and when any water is distributed to States under this treaty. NEW DELHI: Soon after they caused significant damage to Pakistani military infrastructure during Operation Sindoor, Indian forces are placing mega orders for the Indo-Russian joint venture BrahMos supersonic cruise missiles. Top defence sources told ANI that a high-level defence ministry meeting is expected to give clearance to the procurement of a large number of BrahMos missiles for the Indian Navy warships, along with ground and air-launched versions of these weapons for the Indian Air Force soon. The missiles were used in a big way to hit Pakistani air bases and Army cantonments all along its length and breadth during the four-day conflict. The Navy would be using the missiles for equipping its Veer-class warships while the Indian Air Force would be using them to equip its Russian-origin Su-30 MKI fighter jet fleet, the sources said. Recently, Prime Minister Narendra Modi praised the performance of the indigenous weapon systems in the conflict, saying, During Operation Sindoor, the world saw the capabilities of our indigenous weapons. Our Air Defence Systems, missiles, and drones have proved the strength of 'Atmanirbhar Bharat', especially the Brahmos missiles. CHANDIGARH: Dera Sacha Sauda chief Gurmeet Ram Rahim Singh, a 57-year-old convict in rape and murder cases, walked out of Sunaria jail on his 14th temporary release since 2017. The self-styled godman was granted a 40-day parole this time. Sources said Ram Rahim Singh left Sunaria jail early at 6 AM under tight police security and reached the Dera headquarters in Sirsa around 9 AM in a cavalcade of seven SUVs. This will be the first time in eight years that he will celebrate his birthdayon August 15at the Sirsa dera. In the past, during previous paroles or furloughs around this occasion, he had mostly stayed at his Barnawa Ashram in Uttar Pradesh. He is expected to remain at the Sirsa dera until returning to jail on September 14. According to sources, this will be his 58th birthday, though the celebrations are likely to be limited. Before that, he received a 30-day parole in January, a week before the Delhi assembly elections. On October 1 last year, he was also granted a 20-day parole before the October 5 Haryana assembly elections. In total, he has spent 326 days out of jail so far. The paroles and furloughs granted to him have often coincided with elections in Haryana, Punjab, Delhi, or Rajasthan. Dera Sacha Sauda has a large following across these states, especially in Haryanas Sirsa, Fatehabad, Kurukshetra, Kaithal, and Hisar districts. He is currently serving a 20-year sentence for the rape of two female disciples, a conviction handed down by a special CBI court in August 2017. In January 2019, he was also convicted, along with three others, for the murder of journalist Ram Chander Chhatrapati and sentenced to life imprisonment. Punjab launches Yudh Nasheyan Virudh 2.0 to fight against drugs with public participation

CHANDIGARH: The Punjab government on Monday rolled out the second phase of its anti-drug campaign, Yudh Nasheyan Virudh 2.0, aiming to involve citizens directly in the war against drugs. As part of this initiative, Defence Committees will be formed in both rural and urban areas to help uproot drug trafficking networks. These village-level (rural) and ward-level (urban) committees will consist of 10 to 20 members each, serving as community vigilantes to monitor and report drug-related activities. They will work closely with the police to keep peddlers and smugglers out of their areas. Chief Minister Bhagwant Mann said the campaign, which began on February 4 this year, has reached its final phase. The backbone of the drug supply chain has been broken. These committees will now ensure that our villages and cities remain drug-free, he said. Addressing newly formed committee members, Mann described them as generals in this war against drugs, and expressed confidence in the publics ability to transform Punjab. We have dreamt of making Punjab vibrant again, and with your cooperation, no power in the world can stop us, he said. Each committee will be anchored by four core members: the village sarpanch or ward councillor, a representative from the anti-drug campaign, the BDPO or their representative, and the SHO or their representative. Only individuals with clean reputationssuch as retired army personnel, teachers, and respected community memberswill be eligible to join. The committees will be officially notified by the local SDM, and members will receive government-issued ID cards to facilitate coordination with authorities. Round-the-clock surveillance will be maintained in all areas to prevent trafficking, and members will also support drug rehabilitation and reintegration of former addicts into society. Villages and wards achieving 100 per cent drug-free status will receive formal recognition and certificates of appreciation from the government. Awareness campaigns through street plays, door-to-door outreach, and school programs will also be conducted. Mann said more than 10,000 village-level meetings have already been held, with many Panchayats passing resolutions declaring their areas drug-free. 'A pool of evidence being presented in court aginst Majithia' Taking aim at past governments, Mann said, If earlier administrations had restrained drug traffickers, such programs wouldnt be necessary. Governments usually form development committeesnot defence committees. He accused traditional political parties of collusion and shielding each others wrongdoings. The Chief Minister also pointed to the recent arrest of Shiromani Akali Dal leader Bikram Singh Majithia and said that a basket full of evidence is being presented in court. He questioned the motives of leaders from Congress and BJP who publicly defended Majithia, asking whether they were hand-in-glove with drug smugglers. Without naming names, Mann mentioned Congress leaders Charanjit Singh Channi, Partap Singh Bajwa, Ravneet Singh Bittu, BJPs Capt Amarinder Singh, and AAPs Sukhpal Singh Khaira as having spoken in support of the accused. High court asks accused in cheating case with Navjot Sidhu's wife to deposit passport and participate in mediation
