Can you be charged with drunk driving if you only smell of alcohol?

The Uttarakhand High Court stated alcohol smell alone is insufficient for drunk driving charges. Scientific evidence like blood tests is now mandatory to prove intoxication levels. This ruling came after a fatal road accident involving Amar Singh near Badrinath Dham. The court quashed culpable homicide charges due to lack of scientific proof. However, charges of negligent driving and endangering lives will proceed.
