Bombay HC offers John Cockerill Hamon interim relief in trademark dispute

The Bombay High Court has temporarily restrained Hamon Cooling Systems from using the 'Hamon' trademark. John Cockerill Hamon SA established a prima facie case for owning the brand after a cross-border insolvency process. The court found no merit in the defendant's claims of acquiescence and delay. The defendants are derivative users whose authority to use the marks has expired.
