NEW DELHI: As the campaign for the phase five of the Lok Sabha elections ended on Saturday evening, Congress leader Priyanka Gandhi Vadra made her final pitch for Congress candidate Kishori Lal Sharma who is locked in a fierce battle against Union minister and BJPs incumbent MP Smriti Irani. With elections two days away, enthusiasm among the Congress workers was palpable as the cavalcade of the Congress general secretary reached Amethi to hold a roadshow along with Sharma. Judicial officer who defiles his office merits no mercy: HC The Allahabad High Court has upheld the dismissal of a judicial officer accused of demanding dowry and attempting to influence a junior judge in the case. If there exists a temple of justice, the judicial officers must act like its high priests, a bench comprising justices Saumitra Dayal Singh and Donadi Ramesh said and stressed that a judicial officer who defiles his office merits no mercy. Dismissing a writ petition filed by Umesh Kumar Sirohi, an additional district judge who was removed from service, the court said, ''Any transgression committed by a judicial officer to extract benefit for himself or those to whom he may be closely related would always be dealt with severely''. In the present writ petition, the petitioner has challenged the penalty order passed by the state government dated April 16, 2021, whereby Sirohi - then serving as additional district and sessions judge, Lalitpur - was removed from service with immediate effect. ''Once the 'bad fish' is identified, it may not be retained in the 'tank'. No room may ever exist and no margin of error may be permitted as may allow any possibility for a judicial officer to seek to influence another judicial officer in the exercise of judicial function. ''If there exists a temple of justice, the judicial officers must act like its high priests who must not only conduct the rituals involving the discharge of their duties on the dais but they must zealously guard the purity of the temple itself,'' the court said. The two charge sheets were issued against the petition by the administrative side of the High Court in 2016 and 2017. In the first charge sheet, Sirohi was accused of demanding dowry for the marriage of his brother, also a judge, and inflicting an injury on his own hand as a conspiracy to implicate his brother's wife and her family. Sirohi's wife had registered a police complaint in this regard against the sister-in-law and her family members, leading to the registration of a case against them. Another allegation against Sirohi and his brother was that they had tried to influence the investigating officer in the matter by misusing their official position. In the second charge sheet, it was alleged that Sirohi had tried to influence an additional chief judicial magistrate in the proceedings of the case registered by his wife. He was also accused of making false allegations of bias against the then district judge, Meerut. In 2020, the High Court accepted the inquiry reports against Sirohi and recommended his dismissal from service. The state accepted the recommendation, leading to his removal from service, which is under challenge in the present writ petition. After hearing the arguments and examining the records, the court concluded that a case of most serious misconduct had been made out against Sirohi. The court noted that charges alleging efforts to influence the investigating officer and demand of dowry were found to be true.

Meanwhile, the special NIA Court on December 12, 2023, extended the time for filing the charge sheet. Considering the entire circumstances, the bench observed, ''The order of the Special Court extending the period of investigation on an application moved by the Investigating Officer is illegal and against the law,'' and granted bail for the accused. Those granted bail are Mohammed Aleem, Mohammad Nawajis Ansari, Lukman, Mudassir, Mohammad Mukhtar, Mohammad Nadeem, Habeedul Islam, Mohammad Harish, Ash Mohammad, Qari Shahjad and Ali Noor.

A bench of Justices Sudhanshu Dhulia and Sanjay Kumar sought response from the Uttar Pradesh government on a plea filed by petitioner Raj Khan, against whom an FIR was lodged under the provision of the UP Gangsters Act in Pilibhit district. ''The impugned order of the high court dismissing the application of the petitioner under section 482 CrPC (Code of Criminal Procedure) is causing immense hardship and injustice to the petitioner as his freedom of life and personal liberty under Article 21 of the Constitution of India has been restrained,'' said the plea, filed through advocate Tanvi Dubey. It alleged that the FIR under the UP Gangsters Act has been registered merely on the basis of an earlier FIR, which was in total abuse of process of law. The plea said the petitioner has no criminal antecedents other than the alleged case and invoking the Gangsters Act against him was not only causing prejudice to him but would lead to ''serious misuse of the police and judicial machinery purely for personal vendetta''. ''The filing of impugned charge sheet and initiation of proceedings against the petitioner is prima facie malicious with ulterior motive for wreaking vengeance upon the petitioner due to personal grudge and him lodging a complaint with the chairman, Sunni Central Waqf Board, Uttar Pradesh with regard to financial irregularities and misdeeds...,'' it said. The plea has urged the apex court to quash the charge sheet and entire proceedings of the case. ''The high court failed to consider that the petitioner who is an innocent citizen has fallen prey to the hands of miscreants for raising his voice against the fraud, misdeeds and misuse of the income generated from the Waqf properties,'' it claimed.

In that case, he got bail from the Allahabad High Court. Bollywood singer and JJP candidate Rahul Yadav Fazilpuria was booked in connection with supply of snake venom to a rave party. Social media influencer Elvish Yadav, who was arrested in the case, had confessed that he made the snake video at a party thrown by Fazilpuria. Elvish and Fazilpuria had featured in several videos that appeared on social media with banned snakes. Fazilpuria was booked on March 30 at Badshahpur Police Station for using various varieties of prohibited snakes in a video song shooting. The matter is under investigation.

Allahabad HC initiates criminal contempt proceedings against 10 attorneys for 'physical assault on litigants' Taking a serious note of assault of litigants at the district court here, the Allahabad High Court has issued criminal contempt notice to ten advocates and also restrained them from entering the district court premises. The high court's notice came after the district judge submitted the report in the case. On April 30, the high court had restrained two lawyers from entering the district court premises for their alleged involvement in the same incident. Some advocates on April 29 entered the senior division court located on the district court premises and allegedly beat up a litigant. Passing its order on Monday, a division bench comprising Justice Ashwani Kumar Mishra and Justice Mohd Azhar Husain Idrisi observed, ''The incident in this case has to be viewed with utmost seriousness. This court cannot allow the court proceedings to be obstructed in a manner that litigants are brutally thrashed in the court room and the presiding officer has to flee to her chamber for her safety.'' ''This type of aggressive and violent conduct in the court will cause a virtual collapse of the system. This court cannot be a silent spectator to events of this kind. A clear and unequivocal message must go to unscrupulous persons that incident of this kind would not be tolerated and shall be dealt with sternly,'' said the bench. It also called upon the commissioner of police, Prayagraj, to ensure that adequate police force is made available on the direction of district judge to allow smooth functioning of the court. The high court also directed the commissioner of police to authorize a responsible officer, not below the rank of assistant commissioner of Police, to specify the criminal history of all the persons against whom notices are issued in the present contempt matter. The status of the investigation or the action taken in this regard should also be specifically disclosed, the court said in its order.

Odisha: Rath work begins, Chandan Yatra kicks off
PURI: Construction of chariots for the annual Rath Yatra of the Trinity commenced on the auspicious occasion of Akshaya Tritiya on Friday. As per tradition, Srimandir servitors brought the agyanmallyas of the Trinity and handed over those to the three Biswakarmas (carpenters) to initiate the process of chariot construction. The ritual began with performance of Homa (yajna) after which the Biswakarmas were accorded ceremonial head gears by the temple administration to begin the construction work. Earlier on Ram Navami, the wooden logs selected for construction of the chariots were consecrated by the temple priests. Meanwhile, the occasion also marked the beginning of Chandan Yatra, the 21-day annual water sports festival of the Trinity in the evening. Madan Mohan, the representative idol of Lord Jagannath, his consort Goddess Lakshmi and Panch Mahadevas believed to be the incarnation of the Panch Pandavas, began their pleasure trip along the Bada Danda (Grand Road) in six separate palanquins from the Shree Jagannath temple to Narendra Pokhari situated around 1.5 km from the shrine. On their arrival, the deities were smeared with sandalwood paste and bathed in aromatic water. The deities were then taken in a procession to their respective boats, Nanda and Bhadra, shaped as giant swans, to enjoy a ride across the pond. The deities were later brought back to the temple. Bhitara Ratna Bhandar to be opened during Rath Yatra The committee formed by the state government to open the Srimandir Bhitara Ratna Bhandar has decided to open the inner chamber of the temple treasury during Rath Yatra which is scheduled to begin on July 7 and continue till July 15. In its second meeting held on Thursday, the committee headed by former Supreme Court Justice Arijit Pashayat also discussed the modalities for opening the treasury. As per the decision taken at the meeting, the committee will make a fresh inventory of the wealth of the deities and compare it with the list made in 1978. Opening of the treasury and enumeration of the wealth will be undertaken under CCTV surveillance for transparency. Sources said the committee will finalise the date of opening of the temple treasury in its next meeting. Among others, chief administrator of the temple Vir Vikram Yadav, former chairperson of Allahabad Bank Bidhubhusan Samal, ASI superintendent DB Garnaik and temple treasurer Jagannath Kar were present.
